EPC 501(c)(3) GROUP EXEMPTION

A benefit of EPC membership is that our churches enjoy a group exemption for tax purposes. In 2020, major changes were implemented by the Internal Revenue Service. For an EPC church to maintain its group exemption status, two important requirements must be met.

• One, all subordinate organizations (member churches) listed under the group exemption must provide written authorization for the central organization (EPC) to list them in the group exemption. This is only necessary one time (it is not an annual requirement).
• Two, the subordinate organization must declare that it understands that it may be removed from the group exemption if it fails to comply with the requirements of the proposed Revenue procedure described in IRS Notice 2020-36 (or other subsequent guidance issued by the IRS).

The form below meets these two requirements. EPC churches that wish to be part of the EPC’s Group Exemption should complete the form, copy or print onto church letterhead (if available), and return to the Office of the General Assembly. To meet the requirements of IRS Notice 2020-36, the form must be signed by a duly authorized officer of the church. The 63-page IRS Notice 2020-36 is provided for reference.

Note that the IRS considers churches as 501(c)(3) non-profit organizations by default. However, virtually all charitable foundations—and many estate planning and legacy gift situations—will require a copy of the church’s 501(c)(3) letter before disbursing funds. EPC churches will receive a copy of this letter if they are a member of our group exemption.
